What is Workmans Compensation?

The Compensation for Occupational Injuries and Diseases Act, no 130 of 1993 (COIDA) provides compensation for disablement or injury caused by occupational injuries or diseases sustained or contracted by employees during their employment or for death resulting from such injuries or diseases.

 

The COIDA Act applies to:

  • All employers employing one or more casual and full-time workers who, because of a workplace accident or work-related disease are injured, disabled, or killed or become ill.

Submission Requirements:

Return of Earnings (RoE) declarations are required to be submitted to the Compensation House annually (31st March). These declarations consist of: actual earnings and provisional earnings resulting in invoices to be paid.

Failure to register for compensation constitutes as an offence.

 

Benefits of workman’s compensation:

Employers are protected against civil claims if a worker is injured on duty and workers who are injured on duty can claim compensation for temporary or permanent disablement. If workers die because of an injury on duty their dependants can claim compensation.

 

How to obtain a Letter of Good Standing:

Once all declarations and payments have been submitted to the Compensation House you will receive a Letter of Good Standing (LoGs). This letter verifies that your company exists, has paid all its statutory dues to COID, met all its filing requirements and is authorised to transact business.

 

This letter is also a requirement for Department of Labour inspections for compliance.
